Terms of sale

Last updated: October 6, 2026

In force as of October 1, 2026.

This is a translation provided for convenience. The French version is the reference and prevails.

Article 1. Purpose and scope

These terms of sale govern the use of the free pre-audit and the purchase of the paid report offered by Banast SASU ("Banast") on banast.com. Information about Banast is available in the legal notice.

They apply to anyone who uses these services ("the Client"), whether acting as a consumer or as a professional. Some clauses apply to only one of these categories, which is then stated.

Any order implies full acceptance of these terms, which the Client acknowledges having read before paying.

Article 2. Services

Free pre-audit. Based on the information provided by the Client (including the address of their site), Banast produces a first analysis of their project. This service is free and comes with no commitment.

Full report. The paid report guides the Client through a structured review of their project: market, customers, competition, offer, business model and acquisition. It ends with a scored assessment and a prioritised action plan. The Client fills in and validates some information along the way.

The essential characteristics of the report are presented on the site before any order.

Article 3. Price

The full report is sold for 20 euros, all taxes included, or its equivalent in the currency displayed at the time of the order: 24 US dollars, 19 pounds sterling, 20 Swiss francs or 35 Canadian dollars. The price paid is the one shown on the payment page. It is a one-time purchase, with no subscription.

The applicable price is the one displayed at the time of the order. Banast may change its prices at any time, with no effect on orders already confirmed.

Article 4. Order

The Client orders online from the site. Before paying, they can check the details of their order and its total price, and correct any errors.

The order is final once paid. Banast sends the Client a confirmation by email, which includes these terms and, where applicable, their waiver of the right of withdrawal.

Article 5. Payment

Payment is made online by card, through the payment provider Stripe. Banast never has access to the Client's card details.

Payment is due immediately upon ordering.

Article 6. Access to the report

The report is available online as soon as payment is confirmed, from the Client's account. The Client can save it as a PDF from their browser and find the full report by signing in to their Banast account.

If they have trouble accessing it, the Client contacts Banast at contact@banast.com.

Article 7. Right of withdrawal (consumers)

The report is digital content supplied without a physical medium, whose performance begins upon payment.

In accordance with article L221-28, 13° of the French Consumer Code, the consumer Client acknowledges, by ticking the box provided at payment, that they request immediate performance and expressly waive their right of withdrawal.

A professional Client has no right of withdrawal.

Article 8. No refunds and warranties

Once the report is accessible, no refund is granted, in particular on the grounds that the content does not meet the Client's expectations.

This clause does not deprive the consumer Client of the legal guarantee of conformity for digital content (articles L224-25-12 and following of the French Consumer Code). In case of non-conformity, in particular if the report is inaccessible or incomplete because of Banast, the Client may obtain that it be brought into conformity or, failing that, a price reduction or the cancellation of the contract.

Article 9. Nature of the service and AI-generated content

The pre-audit and the report are produced in part using artificial intelligence tools, based on the information provided by the Client and on public data.

They are an aid to thinking and decision-making. They do not constitute legal, tax, accounting, financial or investment advice. Estimates (market size, costs, projections, scores) are indicative and may contain errors.

The Client remains solely responsible for the decisions they make based on the report.

Article 10. Client obligations

The Client undertakes to provide accurate information and to hold the necessary rights over the content they submit. They shall not use the service fraudulently, attempt to extract its content by automated means, or compromise its operation.

Article 11. Intellectual property

Banast retains all rights to its methods, analysis frameworks, report templates, interfaces and brands.

The Client remains the owner of the information they provide. They obtain a personal right to use their report, for the needs of their own project. They may freely share the share card provided for this purpose. Any resale or commercial distribution of the report is prohibited.

Article 12. Liability

Banast undertakes to provide the service with due care. It cannot be held liable for an interruption caused by maintenance, a technical provider or force majeure.

Towards a professional Client, Banast's liability is limited, for all damages combined, to the amount paid for the order concerned. Indirect damages, such as loss of revenue or opportunity, are excluded.

Towards a consumer Client, Banast's liability is assessed under the conditions provided by law.

Article 13. Personal data

Banast processes the Client's data to provide the service, manage the order and improve the product. How data is processed and the Client's rights are described in the privacy policy.

Article 14. Changes to these terms

Banast may change these terms. The applicable terms are those in force on the date of the order.

Article 15. Customer service and mediation

For any complaint, the Client contacts Banast at contact@banast.com. Banast aims to reply within 7 working days.

If a dispute remains unresolved, the consumer Client may refer it free of charge to a consumer mediator, within one year of their written complaint. The contact details of the mediator chosen by Banast are provided on request at adrien@banast.com.

Article 16. Governing law and jurisdiction

These terms are governed by French law.

Between professionals, any dispute falls under the exclusive jurisdiction of the courts of Avignon. A consumer Client may bring proceedings, at their choice, before the court of their place of residence or any other court with jurisdiction under the law.
